We provide marketing services on a flat monthly retainer basis. Specific deliverables, timelines, payment terms, and performance expectations are documented in a separate written agreement (proposal or contract) signed between Adtellect and the client.

These Terms apply to website use only. Service-specific terms are governed by the signed client agreement.

5. Payments and Refunds

For website inquiries, no payment is involved.

For clients:

  • All fees, payment schedules, and refund policies are detailed in your individual service agreement
  • Indian GST applies as per current tax laws
  • Late payments may incur interest as agreed in the contract
  • Free audits and consultations are genuinely free — no hidden charges

6. No Guaranteed Results

Performance marketing results depend on many factors — your product, market, budget, creative quality, landing page, sales process, and external conditions like ad platform changes.

While we work hard to deliver measurable outcomes and back our work with proven processes, we do not guarantee specific revenue, ROAS, lead volume, or conversion numbers unless explicitly written into a signed performance SLA.

Any examples, case studies, or testimonials on this website reflect past results from specific clients and do not guarantee similar outcomes for everyone.

7. Third-Party Platforms

Our services rely on third-party platforms like Meta (Facebook/Instagram), Google Ads, YouTube, WhatsApp Business API, and others. These platforms have their own terms, policies, and limitations.

We are not responsible for:

  • Changes in third-party platform policies, algorithms, or pricing
  • Account suspensions or restrictions imposed by these platforms
  • Downtime, technical issues, or data inaccuracies on third-party systems

We will, however, work with you to resolve issues to the best of our ability.

8. Confidentiality

Any confidential information you share with us — about your business, customers, finances, or strategy — will be kept strictly confidential. We are happy to sign mutual NDAs at the start of any engagement.

Likewise, any information we share with you (our processes, frameworks, internal documents) must be treated as confidential and not shared externally without our consent.

9. Limitation of Liability

To the maximum extent permitted by Indian law:

  • Adtellect is not liable for any indirect, incidental, or consequential damages arising from your use of the website or our services
  • Our total liability for any claim related to our services will not exceed the fees paid by you to us in the 3 months preceding the claim
  • We are not liable for losses caused by third-party platforms, force majeure events, or factors outside our reasonable control

10. Termination

For website use: We can suspend or terminate your access if you violate these Terms.

For service contracts: Termination terms (including the 30-day opt-out clause after the initial 3-month period) are governed by your signed agreement, not by these Terms.

11. Indemnification

You agree to indemnify and hold Adtellect harmless against any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of our website or services
  • Any content you provide that infringes third-party rights or laws

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Raipur, Chhattisgarh, India.

We encourage resolving disputes through good-faith conversation before any legal action.

We may update these Terms from time to time. The “Last Updated” date will reflect the latest version. Continued use of the website after changes means you accept the updated Terms.
